LawsuitsNow, more than 5,000 individual lawsuits have been filed involving girls and women who suffered blood clots or gallbladder injuries as a result of their ingesting of YAZ, Yasmin, or Ocella. Litigation is pending in federal court in East St. Louis and Illinois, and in state courts in Pennsylvania (Philadelphia), California, and New Jersey.

More than 40 million pages of documents and dozens of depositions of Bayer’s scientists and executives in the United States and Europe have been completed to substantiate plaintiffs’ claims related to Bayer’s deceptive marketing practices - including confirmation that Berlex and Bayer always intended to promote YAZ and Yasmin for use by women with PMS symptoms despite a lack of FDA approval for that use. Discovery efforts are also focused on proving that there was an orchestrated campaign through third parties, paid consultants, and others to evade FDA regulations, including “pay to play” agreements requiring the manufacturer’s consultants to promote YAZ and Yasmin improperly.

The first trial settings for this litigation are now anticipated for late 2011 or early 2012, with others to follow in the subsequent 9 to 12 months. In the meantime, despite ominous research findings and strong warning labels, millions of young women continue to put their health and lives at risk by using YAZ, Yasmin or Ocella.
